Terms and Conditions

Terms and Conditions of Service

Welcome to the official website of CUSCONOVA TOURS S.R.L. By accessing our platform and booking our travel services, you expressly agree to comply with and be bound by the following terms and conditions:

1. Corporate Identity

All travel services and tour packages are directly commercialized and operated by CUSCONOVA TOURS S.R.L., a fully licensed travel agency registered under Peruvian law with Tax ID (RUC) No. 20613995979, based in Cusco, Peru.

2. Scope of Liability and Force Majeure

CUSCONOVA TOURS S.R.L. acts as a professional local tour operator and formal intermediary between the client and third-party service providers (such as transportation companies, train operators, licensed tour guides, and restaurants). While we guarantee to make every effort to ensure the seamless execution of all itineraries, our company shall not be held liable for delays, cancellations, or service disruptions caused by events of force majeure or acts of God, including but not limited to severe weather conditions, natural disasters, strikes, social unrest, regional protests, or unexpected government-mandated closures.

3. Booking Deposits and Ticket Regulations

Due to the exceptionally high demand and strict government regulations regarding government-issued tickets, a non-refundable 50% deposit is strictly required at the time of booking to immediately secure official train passes and entry permits for the Machu Picchu Llaqta. These official permits are personal, nominative, non-transferable, and non-refundable under Ministry of Culture policies; therefore, once purchased, the 50% deposit cannot be recovered or refunded under any circumstances.

4. Tour Package Exclusions and Optional Services

Standard tour packages marketed on this website do not include hotel or hostel accommodations, nor do they include daily meals unless explicitly specified in writing within a particular itinerary. However, upon prior coordination and mutual agreement with the client, CUSCONOVA TOURS S.R.L. can provide professional recommendations or arrange external lodging and dining reservations on behalf of the passenger. Furthermore, optional local services operated by independent native communities, such as horse rentals and mototax (motocar) transportation at Rainbow Mountain (Vinicunca), are strictly excluded from our package pricing and remain the sole financial responsibility of the passenger.

5. Passenger Responsibilities and Travel Insurance

It is the sole responsibility of the traveler to carry valid, original identification documents throughout the duration of their tours (a valid Passport with at least 6 months of remaining validity for international tourists, or a DNI for Peruvian citizens). Furthermore, passengers are strictly required to obtain their own personal travel and medical insurance. CUSCONOVA TOURS S.R.L. does not provide travel insurance policies and shall not assume any financial liability, medical expenses, refunds, or rescheduling costs if a passenger is injured, falls ill, or is denied boarding or entry to any tourist site.

6. Safety Assistance and Medical Protocol

Our company is fully committed to passenger safety. We provide 24/7 dedicated assistance to our clients once their scheduled tour officially begins. For high-altitude treks and excursions, our field staff carries essential first-aid equipment, including a medical first-aid kit and emergency oxygen tanks. In the event of a medical emergency or severe altitude sickness, our team will provide immediate first-aid support and can assist in recommending or connecting the passenger with specialized local medical professionals; however, all external medical fees, clinic costs, and treatments remain the exclusive financial responsibility of the passenger.

7. Governing Law and Jurisdiction

Any dispute, controversy, or claim arising out of or relating to the interpretation or fulfillment of this travel contract shall be governed by and construed in accordance with the laws of the Republic of Peru. Both parties expressly waive any other territorial jurisdiction and submit exclusively to the competence of the courts of the city of Cusco, Peru.
